(Derived from the Body Corporate By Laws)

  • Every resident is responsible for any breach of these By Laws including any breach by their guests. All residents are bound by these By Laws and any breach thereof or failure to comply with any lawful direction pursuant to these By Laws constitutes a breach of the By Laws and a breach of any applicable resident’s tenancy agreement.
  • Any breach of these By Laws is to be remedied no later than the expiry date for remedy of the breach issued by the Committee.
  • No resident is to create within the Complex any noise likely to interfere with the peaceful enjoyment of other residents. As Clifton Waters is built around a pool/BBQ area, noise ‘echo’s’ around the Complex, particularly at night. Noise must be kept to a fair and reasonable level and respect shown for fellow residents.
  • Swimming Pool: Pool hours are strictly 7.00am to 9.00pm. Running, Jumping, Splashing and Diving is not permitted. Strictly NO SMOKING OR CONSUMPTION OF ALCOHOL OR GLASS BOTTLES OF ANY KIND around the pool. No drunken or disorderly behaviour is permitted.
  • The swimming pool & BBQ area are for use by residents and guests; guests must be accompanied by a resident at all times in this area.
  • Children under the age of 12 are not permitted in the pool/BBQ area without adult supervision at all times.
  • Gymnasium: Gym hours are strictly 7.00am to 8.00pm. The gym is for use by residents only. Residents using the gym do so at their own risk and no liability is accepted by the Body Corporate or Management. Children under 14 years must be accompanied by an adult. Appropriate dry clothing and shoes must be worn. No food or alcohol is to be brought into the gym. Drinks must be in plastic bottles only. Equipment must not be moved or tampered with, and after use, must be wiped with a clean damp cloth. On vacating, you must ensure all equipment, TV, air conditioning, ceiling fans and lights are turned off.
  • Riding of skateboards within the complex is strictly prohibited.
  • Garbage must not be left outside the door of any resident’s apartment at any time, or in common areas or allocated parking spaces.
  • The parking space allocated to your apartment is to be used only for parking vehicles. As each apartment has only one allocated car park, residents with two cars may use a visitor’s car park for the second car strictly at the discretion of Management.
  • No animal is to be kept in an apartment or on Common Property without consent of Management.
  • No items, including clothing, are to be hung upon or from any window or glass door, balcony or railing, external wall of the building, or any Common Property.
  • No external awnings or blinds are to be fitted to any apartment, and no article is to be hung from any window or balcony.
  • No resident shall hang any curtains inside their apartment that are visible from outside the building without the colour and design being approved by the Committee.
  • No resident shall do anything to vary or alter the external appearance of their apartment.
  • No radio or TV antenna is to be installed in any apartment that extrudes beyond the apartment.
  • No resident is to throw or permit to be thrown, or allow to fall, from any window, door or balcony of their apartment, any object, including cigarette butts, rubbish or refuse.
  • No resident is to interfere with, or use any fire equipment other than for the purpose it has been installed, or obstruct any fire exit or means of access to any fire safety equipment.
  • If any infectious disease notifiable under any relevant legislation afflicts any person living or visiting his or her apartment, the resident is to notify Management and the relevant health authority, and pay the Body Corporate the cost of disinfecting the apartment and building, and replacing anything the destruction of which is rendered necessary by the occurrence of the infection.
  • Subject to S 125 of the Community Titles Act, each resident is to permit Management and its agents, at all reasonable times, and on reasonable notice, (except during emergency when no notice will be required) to enter his or her apartment to inspect the condition of any items for the repair and maintenance of which the Body Corporate is responsible, or to maintain, repair or renew pipes, wires, cables and ducts in the apartment, capable of being used in connection with the enjoyment of any other apartment or the Common Property, as well as any other repair or maintenance of Body Corporate property and for the purpose of exterminating household pests.
  • Residents are to report the loss of any security key to Management.
  • No resident shall obstruct or hinder Management in the discharge of his/her duties or any Common Property being used for the exercise of those duties.
  • A resident is not to use or store in their apartment any flammable, explosive or otherwise volatile substance (solid, liquid or gaseous).
  • No apartment is to be used for non-residential purposes without the written consent of the Body Corporate, or to be used for a purpose which is or may be injurious to the reputation of the Complex or cause a nuisance or hazard to any other resident or other person.
  • No resident is to perform any repair or tamper or interfere with any Body Corporate equipment or facility.
  • No residents will display any sign, advertisement, banner or poster in any part of their apartment so as to be visible from outside the building.
  • No resident is to do anything which is likely to increase the level of fire insurance premium payable by the Body Corporate with respect to the building (or any other structure upon the Complex).
  • No resident shall use Common Property in a way which interferes with any other person’s lawful use thereof.
  • Residents are to fasten securely all doors, windows, or other openings to their apartments whenever the apartments are left unoccupied.
  • No resident shall use for their own purpose as a garden any area of the Common Property, or plant anything in any planter unit on Common Property, or to deface or damage in any way any Common Property, or damage or interfere with any lawn, garden, tree, shrub, plant or flower forming part of, or situated upon, the Common Property.
  • No resident is to obstruct any driveway or path of the Common Property, in particular with a vehicle, other than to enter in or exit from the complex.
  • Residents must not waste reticulated water and must ensure that all taps are promptly turned off after use, and Management is immediately advised of any worn or defective tap washers.
  • Any expense caused to the Body Corporate through the negligence or misuse of water apparatus by a resident is to be reimbursed upon demand by the Body Corporate.
  • Each resident is to ensure their apartment, car park and storage area is kept clean and free of accumulated garbage and pest infestation.
  • Management may arrange for the removal from the Complex any resident or guest who breaches the by laws by behaving in a manner which interferes unreasonably with the quiet use and enjoyment of the Complex by others.

Q: Who do I contact for electricity supply?

Q: What do I do about a water supply account?

A: As there are no individual water meters for each unit the water charges are calculated and apportioned equally to all owners at Clifton Waters by the Cairns Regional Council (via individual accounts sent out every four months). Tenants are not charged separately for water.

Q: Is there a gas supply?

Q: How do I arrange an NBN phone/broadband connection?

Q: Can I get Foxtel?

A: Yes, each unit has a TV outlet carrying free to air and Foxtel so please contact Foxtel directly to arrange an account and for delivery of a set top box. 

Q: What do I do if I lock myself out of my unit?

A: If you are a tenant please contact your letting agent or call a locksmith – please understand that the Unit Managers will NOT unlock any unit due to liability and legal consequences. If you are an owner you may, at your own discretion, entrust a key with the complex manager for emergencies and any planned or body corporate maintenance access (by prior mutual agreement).

Q: What do I do if there is an emergency situation requiring a first responder – police, fire or ambulance?

Q: Who do I contact if there is any anti-social disturbance after hours (10 pm) e.g. shouting, loud music or TV, or singing etc?

A: Try a direct friendly and courteous approach first and then, failing any response, call Policelink on 131444  for prompt police attendance!

Please note the After Hours Manager has no delegated, effective, or special authority to intervene – we WILL report any by-law breaches to the responsible letting agent or to the Body Corporate Committee.

Q: What do I do if the vehicle gate stops working or there is a hazardous situation in any public area of the complex e.g. flooding, broken glass, tripping hazards, toxic or biohazard material (blood)? 

A: Contact the Manager on 0421 284 431 or, after hours (6 pm – 8 am + weekends) call the After Hours manager on 0435 423 865 (Unit 108).

Q: How do I purchase a replacement gate remote?

A: Contact the Complex Manager to arrange purchase of a coded remote for $60.

Q: How do I access the front pedestrian gate, gym and pool toilets?

A: The original master key system provided all individual unit residents with common access to the above however, over time, some units have had locks changed and so this is now not the case for some residents. A suitable key may be purchased by arrangement with the complex manager.

Tom Cowles Locksmiths in Cairns hold the master key system data if this service is required by unit owners.
